Sale Or Return Terms & Conditions 4.7

 

We’ve designed this agreement to be as clear and transparent as possible. If anything’s unclear, just ask — we’re happy to help. Think of this like selling a house: it takes a little time, a little trust, and a clear plan to make it smooth for everyone involved.

Section 1: Seller's Guarantees
1.1 You confirm that you're the legal owner of the vehicle — or have full authority from the legal owner — and that it’s free to be sold, with no loans, finance, or surprises we don’t already know about. 1.2 Everything you've told us about the vehicle is true and accurate, including mileage, condition, previous repairs or damage — anything a buyer would want to know. It’s all logged in the notes section of this agreement. 1.3 You've told us anything that might affect someone’s decision to buy the vehicle. 1.4 If it turns out something wasn’t disclosed, or there’s a legal issue (like shared ownership or finance), you agree to cover us for any costs, claims or issues that arise.

Section 2: Dealer's Obligations
2.1 We’ll advertise and promote your vehicle based on the information you've provided. If it hasn’t sold by the agreed date, you can cancel with 24 hours’ notice, collect the vehicle, and just settle any agreed costs we've incurred. 2.2 While your vehicle is with us, it’s fully insured. We also cover the cost of promoting and preparing it for sale.

Section 3: Fees and Charges
3.1 Our upfront SOR fee is £249. This covers admin, compliance checks, stocking, and more. If you extend the agreement: 2 months £120, 4 months £150. 3.2 If the agreement expires and you don’t renew or collect, a rolling fee of £4.20/day applies — cancellable with 24 hours’ notice.

Section 4: Insurance & Personal Belongings
4.1 Your vehicle is insured for theft and fire while on site. We’re not liable for wear and tear, water ingress, rust, electrical/mechanical issues, or damage related to vehicle condition. 4.2 Please remove all personal items before handing over the vehicle. We can’t be responsible for anything left behind.

Section 5: Timing Belt
5.1 If your vehicle has a timing belt, we’ll need proof of its last replacement. No proof? We’ll replace it and deduct the cost (typically £550–£945 depending on model) from your sale proceeds.

Section 6: Outstanding Finance
6.1 Got outstanding finance? No problem — we’ll settle it directly with the lender. We’ll deduct the balance plus a £35 admin fee from your sale proceeds.

Section 7: Vehicle Submission Requirements
7.1 Please bring the vehicle in with at least ¼ tank of fuel. If not, we’ll top it up and deduct the cost.

7.2 Make sure the toilet cassette is clean and empty. If it’s not, we’ll fit a new Thetford Fresh-Up Kit and deduct £156 from the final payment.

7.3 If the Seller wishes for the vehicle to be declared SORN (Statutory Off Road Notification) whilst the vehicle is in AMC’s possession, this remains entirely the Seller’s responsibility. Where AMC agrees to assist or carry out this process on the Seller’s behalf, AMC accepts no responsibility for any errors, delays, or failure of the SORN process. The Seller is solely responsible for verifying that the vehicle has been correctly declared SORN with the relevant authorities.

Section 8: Post-Sale Arrangements
8.1 Once your vehicle is sold and collected by the new owner, your funds (minus our commission and any applicable deductions) will be paid no sooner than 31 days after the date of collection. This 31-day delay begins only after the buyer has physically collected the vehicle — not from the time they place a deposit. During busy periods, it may take several weeks to arrange handover due to preparation work, scheduling, and customer logistics. From the time a buyer places a deposit to the time your funds arrive in your bank account, it may take several weeks — sometimes longer. We understand it’s a wait, but this window allows for post-sale checks, admin, and any potential buyer issues. It also helps us ensure a smooth, compliant process for all parties.

8.2 If the vehicle is returned to AMC within the 31-day holding period due to a mechanical or functional fault, AMC will attempt to claim repair costs under any applicable warranty in the first instance. Where warranty coverage is not available, and the fault must be repaired to comply with consumer protection law or to fulfil the Buyer’s rights under the Consumer Rights Act 2015, AMC reserves the right to carry out the necessary work and deduct the associated costs from the Seller’s sale proceeds. Costs will include parts at trade price, labour at a discounted rate of £24/hour (down from £85), and any required third-party or specialist work. AMC will provide a breakdown of all deductions upon request.

8.3 If the buyer rejects the vehicle under the Consumer Rights Act, AMC will continue to advertise and attempt to resell it until the end of the Sale or Return agreement. If the vehicle remains unsold when the contract expires, the Seller will be liable for all reasonable costs incurred in preparing, inspecting, marketing, or repairing the vehicle for sale. The Seller may choose to renew the agreement at that point to give AMC more time to achieve a sale. If the Seller instead chooses to cancel the agreement, they will also be liable for all other applicable charges and fees outlined in this document.

8.4 The Seller agrees that AMC may process, share, or disclose information supplied during the course of this agreement where such disclosure is considered reasonably necessary for the purposes of transaction administration, contractual performance, post-sale obligations, record keeping, regulatory compliance, dispute resolution, or any ancillary matter arising from or connected with the sale of the vehicle. The Seller expressly authorises such disclosure where required in the ordinary course of business.

Section 9: AMC Purchase Offers
9.1 Sometimes, we might offer to buy your vehicle ourselves. Unless we say otherwise in writing, we’re acting as your agent selling it on your behalf.

Section 10: Contract Cancellation
10.1 If you choose to collect your vehicle before the contract ends or after accepting an offer, a storage charge of £29.99/day applies, plus a £1,000 release fee. 10.2 We can remove the vehicle from sale if you haven’t told us about an issue, or the vehicle is found listed for sale elsewhere. You’ll receive a Withdrawal From Sale Notice and must collect the vehicle within 7 days. After 7 days, a £29.99/day storage fee and £400 admin fee will start to apply. After 90 days, we may sell or dispose of the vehicle to recover outstanding costs. Any surplus after clearing your balance will be returned to you. All debts must be cleared before releasing sales funds or the vehicle.

Section 11: Vehicle Condition
11.1 Your vehicle must be mechanically sound and meet RAC standards. We’ll check everything (including a pre-sale habitation check). If we find problems, we’ll quote for repairs — you can use our quote or get your own. If you decline the work, the contract may be cancelled and the vehicle must be collected. A storage fee of £4.20/day (from contract date) and £200 release fee will apply.

11.2 MOTs must be valid while the vehicle is on site. If it expires, we’ll renew it at your cost (£54.65).

Final Declarations
Acknowledgement of Understanding: The Seller confirms that they have read and understood all sections of this agreement and have had the opportunity to ask questions or seek independent legal advice prior to signing. This agreement is binding under English law. Appraisal Acknowledgement: The Seller agrees with the findings noted during the initial visual appraisal of the vehicle. They understand that this appraisal is usually completed at intake by a member of the AMC team and is not a technician’s inspection. It is separate from, and should not be confused with, the full RAC mechanical inspection or the pre-sale Habitation check referenced elsewhere in this agreement. The Seller acknowledges that any repair costs discussed at this early stage are indicative only, and that additional charges may arise as a result of further detailed checks carried out during preparation for sale. Authority to Sell: The Seller confirms they are the legal owner, or have full written authority from the legal owner, to enter into this agreement. If this turns out not to be the case, AMC reserves the right to recover any associated costs or losses from the person who signed this contract. Confirmation of Bank Details: The Seller confirms that the bank details entered on the previous page are correct. AMC accepts no responsibility for payments made to incorrect accounts due to inaccurate information. Final Consent: By signing this agreement, the Seller consents to AMC Motorhomes Ltd selling the vehicle or caravan listed on page 1 and agrees to all the terms above.
