NEW VEHICLE TERMS & CONDITIONS 2.0

 

1. Company Information & Consumer Rights

AMC Motorhomes Ltd is registered at Amelia House, Crescent Road, Worthing, England BN11 1RL, registration number 08739400.

It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please discuss your concerns with us before taking any other action.


2. Inspection Prior to Sale

By signing this order form, you confirm that you have personally inspected either the actual vehicle you are purchasing or, in the case of a factory-ordered model, a representative model of the same make and specification as discussed with our sales representative.

You acknowledge that:

• You are satisfied that the vehicle meets your requirements for quality, specification, and suitability for your intended use.

• Where a vehicle is ordered from the manufacturer, minor variations may occur during production (for example trim, fabric shades, component brands) which do not materially affect the specification or intended purpose.

Such variations do not entitle the customer to cancel the contract, reject the vehicle, or claim compensation, provided the vehicle is of satisfactory quality, fit for purpose, and as described under the Consumer Rights Act 2015.

Any concerns must be raised prior to placing your order.


3. Estimated Collection Timeframe

AMC Motorhomes Ltd will provide an estimated collection timeframe based on information supplied by the manufacturer and current production schedules.

This timeframe is given in good faith but is not guaranteed, and may be subject to change due to factors outside our control, including (but not limited to):

• Manufacturer production delays
• Transport or shipping delays
• Supply chain issues
• DVLA registration processing

Customers are strongly advised not to make non-refundable or inflexible travel, accommodation, or other arrangements based on this timeframe.

AMC Motorhomes Ltd shall not be liable for any costs or losses incurred due to changes or delays to the estimated collection timeframe.


4. Payment of Outstanding Balance & Registration

We accept card payments for deposits and workshop jobs only. The remaining balance must be paid via bank transfer.

Full payment is required at least 10 working days prior to collection to allow:

• Request of the Certificate of Conformity (COC)
• DVLA registration

The V5C logbook will be sent directly to the customer by the DVLA.

Vehicles will be registered in accordance with the manufacturer’s standard supplied specification, including the factory designated Maximum Authorised Mass (MAM), unless alternative instructions are expressly requested by the customer and clearly recorded on this order form at the point of sale.

Where a customer requires the vehicle to be registered at a different MAM, plated weight, or alternative weight classification to that supplied by the manufacturer, this must be specifically requested, agreed by AMC Motorhomes Ltd, and documented on this order form prior to registration.

Where no alternative instruction is recorded on this order form, AMC Motorhomes Ltd shall register the vehicle in accordance with the manufacturer’s supplied specification, and the customer accepts responsibility for ensuring that such specification is suitable for their driving licence entitlement, payload requirements, and intended use.

Any request to alter, uprate, downrate, re-plate, or re-register the vehicle after registration has been completed shall be entirely at the customer’s cost, including but not limited to administrative fees, engineering modifications, certification costs, and any associated downtime or loss of use.

 

It is the customer’s responsibility to ensure the selected MAM is suitable for their licence, payload requirements, and intended use.

All new motorhomes will be supplied with approximately £55 of fuel. This fuel charge forms part of the vehicle preparation process and shall be automatically added to the customer’s final invoice.


5. Identity Verification

Under UK law, including the Anti-Money Laundering Regulations and the Economic Crime and Corporate Transparency Act 2023, we are required to verify your identity.

We may request:

• Photo ID
• Proof of address
• Electronic verification

Failure to comply will be treated as a breach of contract, and AMC reserves the right to terminate the agreement and retain any deposit paid.


6. Third-Party Insurers

Unless you opt out, your details may be passed to an insurance provider to obtain a no-obligation quote.


7. Deposit & Formation of Contract

A deposit equal to 10% of the total purchase price is required to secure the vehicle and form the purchase contract.

For orders placed at trade shows, exhibitions, or promotional events (including but not limited to the NEC Show), AMC Motorhomes Ltd may, at its discretion, accept a reduced initial deposit of no less than £4,000 at the point of order.

Where a reduced initial deposit is accepted, the customer must pay the remaining balance required to bring the total deposit to the full 10% value within 60 calendar days of the order date unless otherwise agreed in writing by AMC Motorhomes Ltd.

Failure to pay the remaining deposit balance within this period shall constitute a failure by the customer to proceed with the transaction. AMC Motorhomes Ltd reserves the right to cancel the order, retain any deposit monies already paid as compensation towards losses, administration costs, and lost sales opportunity, and immediately remarket the vehicle without further notice.

Formation of Contract

The contract for the purchase of the vehicle is concluded at the point of signing this order form where the customer is physically present and dealing directly with AMC Motorhomes Ltd representatives.

This constitutes an on-premises contract and not a distance or off-premises contract for the purposes of the Consumer Contracts Regulations 2013.

Accordingly:

• The transaction does not constitute a distance or off-premises contract
• The statutory 14-day cooling-off period does not apply

Any balance of deposit paid after the order date is a deferred payment obligation only and does not affect the formation or validity of the contract.

Deposit Refunds

Deposits are non-refundable except:

Where AMC is unable to supply the vehicle
Where delivery is delayed beyond 90 days from the estimated date (subject to reasonable extensions outside our control)
Ownership of the vehicle remains with AMC until full payment is received.


8. Part Exchange

We may offer a valuation based on customer representations and visual appraisal. Final value is subject to full inspection.

If the vehicle is materially different in condition, we reserve the right to revise the valuation.

Ownership & Disposal

Upon delivery:

• Ownership transfers immediately to AMC Motorhomes Ltd
• We reserve the right to sell or dispose of the vehicle immediately

Early Delivery & Conditional Value

Where a part exchange is provided before completion:

• The valuation is conditional upon completion of the main transaction

• If the transaction does not proceed, AMC may treat the vehicle as a standalone trade purchase

The value applied will be the lower of:

• The agreed value
• The actual resale value achieved (less reasonable costs including but not limited to preparation, storage, disposal, and resale costs)

Finance Settlement

Where AMC settles outstanding finance:

• This is deducted from the agreed valuation

If the transaction does not complete:

• Any shortfall remains the responsibility of the customer

Customer Acknowledgement

Early delivery of a part exchange vehicle is done at the customer’s risk, and valuation is not guaranteed unless the purchase completes.

Finance Responsibility Prior to Completion

Any outstanding finance on the part exchange vehicle remains the responsibility of the customer until it is settled by AMC Motorhomes Ltd as part of the transaction.

Where a part exchange vehicle is delivered prior to completion, the customer acknowledges that they may remain liable for ongoing finance payments until the purchase of the new vehicle is completed or the finance is otherwise settled.


9. Cancellation by the Customer

Cancellation will result in the loss of the deposit.

AMC reserves the right to recover costs including:

• Accessories ordered or fitted
• Preparation costs
• Depreciation
• Modifications requested

10. Rejections & Complaints

Customers should contact the Workshop Manager in the first instance.

If unresolved, escalate to management.

All returns must be brought back to the Hailsham site at the customer’s expense.


11. Warranty and Liability

Warranty registration requires submission of the V5C logbook.

Manufacturer warranties apply, including:

• Fiat: 2-year warranty

• Pilote: 2-year habitation warranty plus 5-year water ingress warranty

Warranty conditions must be adhered to.

AMC shall not be liable for indirect or consequential losses.

Customers are responsible for ensuring suitability of vehicle use.


12. Communication & Abandonment

AMC Motorhomes Ltd will contact the customer as the vehicle progresses and when final payment is required.

The customer agrees to remain contactable throughout the transaction.

If AMC is unable to contact the customer, or the customer fails to respond to reasonable communication attempts including telephone, email, and written communication for 14 consecutive days, AMC reserves the right to:

• Treat the order as abandoned
• Cancel the contract
• Retain any deposit paid
• Re-market the vehicle

AMC Motorhomes Ltd will make reasonable attempts to contact the customer before taking such action.


Declaration

By signing below, you confirm that you have read, understood, and accepted these Terms & Conditions and agree to be bound by them.
