New Sale Terms & Conditions

 New Vehicle Terms & Conditions 1.5

1. Company Information & Consumer Rights

1.1 AMC Motorhomes Ltd is registered at Amelia House, Crescent Road, Worthing, England BN11 1RL, registration number 08739400.

1.2 We can be contacted by post at A22 Lower Dicker, Hailsham BN27 4BG, by telephone on (01323) 449 146, or by email at [email protected].

1.3 It is our responsibility to supply you with goods that meet your consumer rights. If you have any concerns that we have not met our legal obligations, please discuss your concerns with us before taking any other action.

2. Inspection Prior to Sale

2.1 By signing this order form, you confirm that you have personally inspected either the actual vehicle you are purchasing or, in the case of a factory-ordered model, a representative model of the same make and specification as discussed with our sales representative.

2.2 You acknowledge that you are satisfied that the vehicle meets your requirements for quality, specification, and suitability for your intended use.

2.3 Where a vehicle is ordered from the manufacturer, minor variations may occur during production, including but not limited to trim, fabric shades, component brands, materials, finishes, or other specification details which do not materially affect the specification or intended purpose of the vehicle.

2.4 Such variations do not entitle the customer to cancel the contract, reject the vehicle, or claim compensation, provided the vehicle is of satisfactory quality, fit for purpose, and as described under the Consumer Rights Act 2015.

2.5 Any concerns must be raised before placing your order.

3. Estimated Collection Dates

3.1 AMC Motorhomes Ltd will provide an estimated collection date or timeframe based on information supplied by the manufacturer and current production schedules.

3.2 This date or timeframe is given in good faith but is not guaranteed and may be subject to change due to factors outside our control, including but not limited to:

manufacturer production delays;
transport or shipping delays;
supply chain issues;
parts availability;
DVLA registration processing;
delays in receiving documentation, including Certificates of Conformity.
3.3 Customers are strongly advised not to book non-refundable or inflexible campsites, ferries, travel, accommodation, or any other related services based on an estimated collection date.

3.4 AMC Motorhomes Ltd shall not be responsible for any losses, costs, cancellation charges, inconvenience, or consequential losses incurred due to changes or delays to the estimated collection date or timeframe.

4. Payment of Outstanding Balance & Registration

4.1 Although we accept card payments for your initial deposit and any future service works, please note that we cannot accept card payments for the remaining balance on the purchase of your motorhome. All final payments must be made directly into our bank account, the details of which are provided overleaf.

4.2 To ensure accuracy when transferring funds, you may first send a small test payment as confirmation. We will verify receipt before you proceed with transferring the remaining balance.

4.3 Full payment for new vehicles is required a minimum of 10 working days prior to the scheduled collection date. This is required to allow AMC Motorhomes Ltd to request the Certificate of Conformity, complete the DVLA registration process, and ensure all financial transactions are completed before the vehicle is registered.

4.4 Once the vehicle is registered in your name, the V5C log book will be sent directly to your specified address by the DVLA.

4.5 Vehicles will be registered in accordance with the manufacturer’s standard supplied specification, including the factory-designated Maximum Authorised Mass, unless alternative instructions are expressly requested by the customer and clearly recorded on this order form at the point of sale.

4.6 Where a customer requires the vehicle to be registered at a different Maximum Authorised Mass, plated weight, or alternative weight classification to that supplied by the manufacturer, this must be specifically requested, agreed by AMC Motorhomes Ltd, and documented on this order form prior to registration.

4.7 Where no alternative instruction is recorded on this order form, AMC Motorhomes Ltd shall register the vehicle in accordance with the manufacturer’s supplied specification. The customer accepts responsibility for ensuring that the specification is suitable for their driving licence entitlement, payload requirements, and intended use.

4.8 Any request to alter, uprate, downrate, re-plate, or re-register the vehicle after registration has been completed shall be entirely at the customer’s cost, including but not limited to administrative fees, engineering modifications, certification costs, and any associated downtime or loss of use.

4.9 All new motorhomes will be supplied with approximately £55 of fuel. This fuel charge forms part of the vehicle preparation process and shall be automatically added to the customer’s final invoice.

5. Third-Party Engagement

5.1 Unless you opt out, we may pass your details to a third-party insurer to provide you with a no-obligation insurance quote.

6. Identity Check

6.1 Under UK law, including the Anti-Money Laundering regulations and the Economic Crime and Corporate Transparency Act 2023, we are legally required to verify the identity of our customers in certain circumstances. This helps prevent fraud, money laundering, and other financial crimes.

6.2 To comply with these obligations, we will need to see a valid form of government-issued identification, such as a passport, driving licence, or national ID card, along with proof of address, such as a recent utility bill or bank statement. In some cases, we may also need to perform electronic verification.

6.3 If you are unable or unwilling to provide acceptable identification, we reserve the right to refuse the transaction, and any deposit paid may be retained.

7. Your Deposit

7.1 Deposits are non-refundable unless a different agreement is made in writing, except where the customer has a legal right to cancel the transaction.

7.2 You are entitled to a full refund of the deposit in these circumstances:

If we notify you that we are unable to complete your order for any reason.
If the vehicle is not prepared for delivery by AMC Motorhomes Ltd within 90 days of the estimated delivery date.
7.3 However, this 90-day period does not include delays caused by factory production issues, transport delays, shipping delays, supply chain issues, parts availability, DVLA delays, or other circumstances outside AMC Motorhomes Ltd’s reasonable control. Any such delays shall extend the 90-day period accordingly.

7.4 The ownership of the goods remains with AMC Motorhomes Ltd until full payment, including any part-exchange vehicle, is received.

7.5 By signing below, you acknowledge and agree to these terms.

8. Part Exchange

8.1 Where you are part-exchanging a vehicle, any agreed part-exchange valuation is based on the information provided by you, a visual appraisal, and the assumption that the vehicle is materially as described.

8.2 While we factor in a reasonable allowance for minor expected repairs when offering a part-exchange price, we reserve the right to adjust the agreed value if the part-exchange vehicle is found to be of lesser value following inspection.

8.3 Before delivering your part-exchange vehicle to AMC Motorhomes Ltd, you may be required to have a habitation inspection carried out by an NCC Approved Workshop or other suitably approved/qualified habitation inspection provider accepted by AMC Motorhomes Ltd.

8.4 Any such habitation inspection must be completed at your cost, and a copy of the report must be supplied to AMC Motorhomes Ltd before or at the time the vehicle is delivered.

8.5 If the habitation report identifies damp, gas issues, electrical faults, appliance faults, water ingress, safety concerns, or other defects affecting the value, safety, saleability, or suitability of the vehicle, AMC Motorhomes Ltd reserves the right to revise the part-exchange valuation, require repairs, or refuse the part exchange.

8.6 AMC Motorhomes Ltd may still carry out its own inspection after the vehicle is delivered. This inspection is not a quick look-over by a salesperson, but a more detailed check carried out in our workshop by trained technicians. To avoid any surprises or delays, we strongly recommend that you bring your part-exchange vehicle to us as soon as possible so these inspections can be completed in good time.

8.7 Upon delivery of the part-exchange vehicle to AMC Motorhomes Ltd, ownership transfers immediately to AMC Motorhomes Ltd unless otherwise agreed in writing.

8.8 AMC Motorhomes Ltd reserves the right to sell, trade, dispose of, or otherwise deal with the part-exchange vehicle immediately.

8.9 Where a part-exchange vehicle is provided before completion of the purchase of the new vehicle, the valuation remains conditional upon completion of the main transaction.

8.10 If the main transaction does not proceed for any reason, AMC Motorhomes Ltd may treat the part-exchange vehicle as a standalone trade purchase.

8.11 In that event, the value applied to the part-exchange vehicle will be the lower of:

the agreed part-exchange valuation; or
the actual resale value achieved by AMC Motorhomes Ltd, less reasonable costs, including but not limited to preparation, storage, repair, disposal, transport, advertising, and resale costs.
8.12 Where AMC Motorhomes Ltd settles outstanding finance on a part-exchange vehicle, the finance settlement amount will be deducted from the agreed valuation.

8.13 If the main transaction does not complete, any shortfall or further finance liability remains the responsibility of the customer.

8.14 Any outstanding finance on the part-exchange vehicle remains the responsibility of the customer until it is settled by AMC Motorhomes Ltd as part of the transaction.

8.15 Where a part-exchange vehicle is delivered to AMC Motorhomes Ltd before completion, the customer acknowledges that they may remain liable for ongoing finance payments until the purchase of the new vehicle is completed or the finance is otherwise settled.

8.16 Early delivery of a part-exchange vehicle is done at the customer’s risk, and the valuation is not guaranteed unless the purchase of the new vehicle completes.

9. Warranty and Liability

9.1 Manufacturer warranties apply to new vehicles in accordance with the manufacturer’s warranty terms and conditions.

9.2 Warranty registration may require submission of the V5C log book or other documentation. The customer is responsible for providing any documentation reasonably required to register or activate any applicable manufacturer warranty.

9.3 Manufacturer warranty terms, conditions, exclusions, service schedules, inspection requirements, and claim procedures must be adhered to by the customer.

9.4 Failure to comply with manufacturer warranty requirements may affect warranty cover.

9.5 AMC Motorhomes Ltd shall not be liable for indirect, consequential, or associated losses, including but not limited to loss of holidays, campsite bookings, ferry bookings, accommodation, travel costs, storage costs, loss of use, or inconvenience.

9.6 Customers are responsible for ensuring that the vehicle is suitable for their driving licence entitlement, intended use, payload requirements, storage arrangements, and personal circumstances.

10. Cancellation

10.1 Cancelling this sales order will result in the customer forfeiting their deposit and, at our discretion, the customer may be liable for further costs, including but not limited to preparation, accessories ordered or fitted at the customer’s request, depreciation of the vehicle while it has been reserved and unavailable for sale, and devaluation of the vehicle due to alterations requested by the customer.

10.2 Any cancellation requests must be made in writing, addressed to Alex McGonigle, Managing Director, or Geoff Takashi, General Manager, via email to [email protected].

10.3 We will reply within 7 working days.

11. Communication and Abandonment

11.1 AMC Motorhomes Ltd will contact the customer as the vehicle progresses and when final payment is required.

11.2 The customer agrees to remain contactable throughout the transaction and to respond to reasonable communication attempts by AMC Motorhomes Ltd.

11.3 If AMC Motorhomes Ltd is unable to contact the customer, or the customer fails to respond to reasonable communication attempts including telephone, email, and written communication for 20 consecutive days, AMC Motorhomes Ltd reserves the right to treat the order as abandoned.

11.4 Where an order is treated as abandoned, AMC Motorhomes Ltd reserves the right to cancel the contract, retain any deposit paid, and re-market the vehicle.

11.5 AMC Motorhomes Ltd will make reasonable attempts to contact the customer before taking such action.

12. Complaints and Rejections

12.1 If you experience any problems with your vehicle, please contact our Workshop Manager immediately so we can rectify it promptly.

12.2 If you are dissatisfied with the goods or services provided by us, please speak to your salesperson in the first instance so we can try to resolve the matter.

12.3 A complaint handling procedure is in place. If the matter cannot be resolved, it should be referred to the Managing Director, Alex McGonigle, or the General Manager, Geoff Takashi.

12.4 Please note, any rejected vehicle must be returned to AMC Motorhomes Ltd, Hailsham, by the purchaser, at their expense.

13. Declaration
